H-1B Visa

H-1B Visa prominent details on should know

The H-1B is a non-immigrant visa in the United States under the Immigration and Nationality Act.It allows U.S. employers to temporarily employ foreign workers in specialty occupations. If a foreign worker in H-1B status quits or is dismissed from the sponsoring employer, the worker must either apply for and be granted a change of status to another non-immigrant status, find another employer (subject to application for adjustment of status and/or change of visa), or leave the United States.the foreign worker must possess at least a bachelor’s degree or its equivalent and state licensure, if required to practice in that field. H-1B work-authorization is strictly limited to employment by the sponsoring employer

The issuance of H1b visa has a limit as well. Six years is the maximum number. Aliens must leave the country for a year before the next H1b visa petition. Three years for an initial issuance and the succeeding three years as the extension comprises the maximum of six years. And after the limited number of years, the alien should consequently leave United States. One exemption though is the aliens employed in the Defense Department. They are allowed to stay within the country for ten years. But in some way, the United States is limiting the quantity of approved H1b visa petitions every year.

H1b VisaFor aliens who are trying to hold an H1b visa, they must be hired and supported first by an American employer. The employers would then take the necessary steps to carry out the application process. All of the important paper works and monetary requirements should be taken cared of by the employer. The employer should follow all governmental rules and regulations throughout the entire period by which the alien is working. The issuance of an H1b visa is a lot more efficient if the employer and the alien would considerably follow all the rules.

Every financial year, there are lot employers who would get hold of the shot to process H1B visa for the competent employees that they get from other countries. Before they initiate working on it, they have to make sure they have accomplished forms, they know the movement of the process and they must also know the requirements from both employer and the non-immigrant employee. For employees for H1B visa, should have attained a bachelor’s degree, they are experienced employees, and can communicate in English either written or verbal. As for employers, since they’re the one accountable to do the application in behalf of the employee, they have to make sure that the employee that they are going to petition has specialty qualifications such as being an engineer, architect etc.. They have to secure the certain forms for the process. Sample for these is the Labor Condition Application or LCA that will be handed in to DOL. When requirements are met, then the process will flow positively.

The tax for an H1b visa holder’s income would depend on the classification of tax purposes. The categories are: non-resident alien or resident alien. The first choice is required to pay for tax throughout the whole stay in the United States. However, the latter is taxed on income within and outside the United States. This categorization is identified by the substantial presence test. If an alien stayed or lived in the United States less than thirty-one days out of last year and one hundred eighty-three days over the last three years then he is considered as a nonresident alien. An H1b visa holder must consider these rules for an effective stay in the United States and a continuously efficient working condition.

Any H1b visa holder may choose a part-time or full-time occupation. This professional may take some time off from work while in a vacation, during unavoidable circumstances such as the health issues or any leave absences. An alien can do such acts without having to think about his visa status. But if an alien will work under another employer during his H1b visa period then the next employer should be responsible for the necessary paper work. However, if an alien will change his specialty then it will be considered as a violation. It might call for legal interventions if the H1b visa holder fails to follow that regulation.
The H1b visa is provided for foreign workers in the United States. The U.S. government would only approve such application for temporary workers. These professionals should work within a specialty job such as the fields on health, engineering, mathematics, law and other specialized fields. There are also some factors that are considered before accepting such application. They must be able to prove that they are fit for the job and are qualified to do the work. In most cases, the H1b visa will be given to those who gained a degree or those professionals who possess the right educational background and with adequate experience.
